Terms & Conditions of SUM GRADS
The SUM GRADS application is owned and operated by SUM GRADS, specializing in organizing graduation events. This application allows users to browse or register for the services provided. By using this application for any reason, including making transactions, you acknowledge that your use is subject to the terms and conditions outlined below:
1. General
We reserve the right to change these terms and conditions at any time. Any changes will be considered effective on the day they are published in the SUM GRADS application. You should read these terms each time you use the application. By registering an account or using the services provided by SUM GRADS, you agree to abide by these terms. If you do not agree to any of these terms, you must stop using the application.
2. Account and Registered Users
2.1. To access certain service features, including the ability to purchase services, you must register and create an account on the application, including a password. Any registered account is personal and exclusive to you and cannot be transferred to any third party.
2.2. When registering and creating an account, you become a "Registered User." To become a registered user, you must provide accurate and correct information (including name, date of birth, and email address) as required during the account creation process.
2.3. By registering and using the application, you guarantee that the information provided during registration is correct and accurate, as it will be used in providing services by the company.
3. Service Request Process
3.1. As a registered user, you can request and purchase various services through the application. If a service requires payment, you must pay the amount as indicated during the ordering process.
3.2. "Confirmation" is the stage that determines the final details of your request. After this, we will send you an email confirming the transaction, including details of the services you have registered for.
4. Payment
4.1. Payments are made using a credit card (only) when we receive your request for the required services and after verifying your card details. Cash payments are not accepted.
4.2. To ensure that the card is not used without your consent, if you wish to use K-Net for payment, you will be directed to the K-Net payment gateway, where you will be required to enter card details (such as card number, expiration date, and PIN). We will verify your name and other information you provided during the service request process using third-party databases. By accepting these terms, you agree to such verification procedures. The personal information you provide may be disclosed to a registered credit reference agency (K-Net), which may retain a record of that information. Please note that this procedure is conducted solely to verify your identity and will not affect your credit rating. All information you provide will be handled securely and in full compliance with applicable laws.
4.3. The responsibility for verifying customers, credit card details, and transaction authenticity lies with the payment gateway and issuing bank. SUM GRADS assumes no liability for any losses or damages resulting from fraudulent transactions due to cyberattacks, theft in the payment gateway or issuing bank, or unauthorized use of credit card details by illegal parties.
4.4. The price you pay for the services you request or register for is the price displayed on the SUM GRADS application at the time your request is received, except in certain cases. Although we ensure that all prices are accurate, errors may occur. If we discover an error in the price of a requested service, we will notify you as soon as possible and give you the option to confirm your order at the correct price. If we are unable to contact you, the order will be considered canceled.
4.5. All prices listed are in Kuwaiti Dinars (KWD) and include applicable taxes (if any) at the current rates but exclude delivery charges unless explicitly stated otherwise.
5. Liability and Cancellation
5.1. SUM GRADS does not guarantee that the application or any of the services or products available through it will be error-free or uninterrupted. Delays or rescheduling of services may occur depending on surrounding circumstances.
5.2. In the event of disasters, pandemics, or conditions that disrupt normal life and result in the postponement of registered services, including events or graduation ceremonies, the user is not entitled to a full refund. SUM GRADS will deduct the costs incurred for the service (event, graduation ceremony, or others) from the time it was made available in the application and refund the remaining amount to the user. Alternatively, users may wait until the service is provided at a later date as announced.
